The governments of Germany, France, and Italy, recognizing the potential of artificial intelligence (AI) development, have recently shifted their stance, releasing a joint agreement stating that Europe needs a regulatory framework for AI that promotes innovation and competition.

This stands in stark contrast to the strict regulatory approach previously conveyed by the EU.

While the EU aims for comprehensive regulation and strict limitations on the most powerful AI models, Germany, Italy, and France seem to prioritize the potential and competitiveness of self-developed large models, even if it means sacrificing some regulatory authority.

In their joint document, Germany, Italy, and France assert that European participants should strive to excel in the global AI competition, using it as a platform to convey European voices and values.

They propose that AI regulation can be achieved through company commitments and a code of conduct for self-regulation.

Big Brothers Rebel First

The EU’s ambitions in AI are both clandestine and overt. While the EU has consistently claimed it will collaborate internationally to establish a global AI regulatory system, its goal is to become the premier AI regulatory body in the Western world, often acting independently.

Germany, Italy, and France seeking alignment with the international community are viewed as a betrayal to the EU. Reportedly, upon hearing about the joint agreement by the three countries, negotiators from the European Parliament chose to withdraw from meetings with EU Council government representatives and EU Commission officials, bringing EU-level legal negotiations to a standstill.

Negotiators need to conclude discussions by December 6, but prospects currently appear bleak. Considering the European Parliament’s re-election in June 2024, it seems challenging for the EU-level AI regulatory framework to be legislated before this time.

Apart from Germany, Italy, and France, other EU countries, particularly Spain, the rotating presidency of the Council, have emphasized expanding the regulatory scope of AI laws to include fundamental models. However, in the alliance of Germany, Italy, and France, it’s difficult for other countries to win in this regard.

Harry Borovick, General Counsel of AI company Luminance, pointed out that the move by the three largest economies in Europe may lead to chaos in EU regulatory discussions. While the joint document is advantageous for business, its impact is limited as it relies on voluntary company commitments. However, it will undoubtedly contribute to internal divisions within the EU and delay discussions.

The Drama of OpenAI Shakes Europe

Controversially, Germany, Italy, and France aim to relax regulation on basic models and encourage industry self-governance, an idea deemed ludicrous by some.

Canadian computer scientist Yoshua Bengio noted that neglecting the management of basic models is a foolish move, turning EU AI laws into a jungle where benign AI systems face strict regulation while potentially dangerous models roam freely.

Meanwhile, the ongoing drama at OpenAI across the Atlantic has also shaken the EU. Brando Benifei, one of the negotiating representatives in the European Parliament, pointed out that OpenAI’s situation indicates that governments cannot rely on voluntary agreements facilitated by industry leaders.

Dutch Minister of Digitalization Alexandra van Huffelen added that the internal strife at OpenAI highlights the lack of transparency in the AI industry and underscores the necessity of regulation.
